On Saturday, February 28, 2009, at approximately 10:02 a.m. Officer Aguilar was on routine patrol in the 700 block of South Plano Street when he observed three subjects acting suspiciously.
Officer Aguilar contacted the subjects and observed one subject, Javier Garcia, concealing something nearby. The other two subjects were identified as Nestor Servin and a 17 year old male juvenile.
Officer Aguilar continued to investigate the incident and located scales commonly used to weigh various drugs for sales, a quantity of marijuana, and other incriminating items. Through the investigation and interviews Officer Aguilar determine all three subjects conspired to sell marijuana for the benefit of their criminal street gang. All three subjects were arrested without further incident.
Mr. Garcia and Mr. Servin were transported to the Tulare County Main Jail, while the male juvenile was transported to the Tulare County Juvenile Detention Center. They were charged with 182 PC-Conspiracy to Commit Crimes; 11359 HS-Marijuana Sales; 11360 HS-Possession of Marijuana for Sales; 148 PC-Delaying/Obstructing a Peace Officer; 186.22 PC-Crimes Committed for the Benefit of a Criminal Street Gang. Mr. Garcia and Mr. Servin were also charged with 272 PC-Contributing to the Delinquency of a Minor.
